ZEMBIRA TERMS OF SERVICE

These Terms of Service govern your access to and use of the ZEMBIRA website, online store, products, digital content, services, and related features (collectively, the “Services”).
By accessing or using the Services, placing an order, purchasing a product, or otherwise interacting with ZEMBIRA, you agree to these Terms of Service. If you do not agree with these Terms, do not use the Services.
SECTION 1 – ABOUT ZEMBIRA
ZEMBIRA operates this online store and offers print-on-demand apparel, digital products, educational resources, and related services.
The store is powered by Shopify, which provides the ecommerce platform that enables ZEMBIRA to offer products and services online.

SECTION 2 – ELIGIBILITY AND USE OF THE SERVICES
You may use the Services only for lawful purposes and in accordance with these Terms.
You must not use the Services in any way that violates applicable laws, infringes the rights of others, interferes with the operation or security of the Services, or attempts to gain unauthorized access to systems, accounts, data, or functionality.
SECTION 3 – PRODUCTS AND PRODUCT INFORMATION
ZEMBIRA offers physical print-on-demand apparel and electronically delivered digital products.
We make reasonable efforts to display product descriptions, images, colors, specifications, dimensions, sizing information, and other product details accurately. However, colors and appearance may vary depending on device screens, materials, printing processes, production conditions, and other factors.
Product availability may change without notice.
SECTION 4 – ORDERS
Submitting an order does not guarantee acceptance of the order.
ZEMBIRA may reject, cancel, or limit an order when reasonably necessary, including in cases involving suspected fraud, payment problems, product unavailability, technical errors, incorrect product information, or other legitimate operational reasons.
If an order is canceled after payment has been successfully collected, any applicable refund will be handled in accordance with the payment method, Shopify processing, and applicable law.
SECTION 5 – PRICING AND PAYMENT
Product prices are shown in the currency displayed by the store.
Prices, shipping charges, taxes, and other amounts applicable to a purchase are displayed during the purchasing process before the customer completes payment.
ZEMBIRA may correct obvious typographical or technical errors in product information or pricing.
Payment processing is handled through Shopify and supported payment providers. ZEMBIRA does not ask customers to send full payment-card information by email or through the contact form.
SECTION 6 – PRINT-ON-DEMAND APPAREL
ZEMBIRA apparel is produced after an order is placed through connected production and fulfillment partners.
Because products are produced specifically for an order, changes, cancellations, returns, replacements, and refunds are subject to the ZEMBIRA Return and Refund Policy and applicable law.
Customers are responsible for reviewing product information, sizing, color, design selection, and shipping details before completing an order.
SECTION 7 – DIGITAL PRODUCTS
Digital products are delivered electronically and no physical item is shipped for a digital-only purchase.
Customers receive a limited, personal, non-transferable right to use purchased digital content for the purpose described in the product listing, unless the product expressly states otherwise.
Customers may not resell, redistribute, reproduce for commercial distribution, upload for public distribution, sublicense, or claim ownership of ZEMBIRA digital products unless expressly authorized in writing by ZEMBIRA.
Digital delivery, access problems, corrupted files, incorrect files, or other technical issues are handled in accordance with the ZEMBIRA Return and Refund Policy.
SECTION 8 – SHIPPING
Physical-product production, shipping, delivery estimates, tracking, address issues, and delivery problems are governed by the ZEMBIRA Shipping Policy.
Digital products do not require physical shipping.
SECTION 9 – RETURNS AND REFUNDS
Returns, refunds, replacements, cancellations, damaged products, manufacturing defects, incorrect products, and digital-delivery problems are governed by the ZEMBIRA Return and Refund Policy.
Nothing in these Terms limits rights available to customers under applicable law.
SECTION 10 – INTELLECTUAL PROPERTY
Unless otherwise stated, the ZEMBIRA name, branding, original graphics, product descriptions, digital content, website content, design elements, and other original materials made available through the Services are owned by or licensed to ZEMBIRA.
You may not copy, reproduce, distribute, sell, publish, modify, exploit, or create unauthorized derivative commercial works from protected ZEMBIRA content except as permitted by law or with prior written authorization.
Third-party trademarks, names, technologies, and content remain the property of their respective owners.
SECTION 11 – CUSTOMER CONTENT, REVIEWS, AND FEEDBACK
If you submit reviews, comments, suggestions, feedback, images, or other content to ZEMBIRA, you represent that you have the right to submit that content and that it does not violate applicable law or the rights of others.
You must not submit content that is unlawful, fraudulent, defamatory, abusive, malicious, infringing, or designed to interfere with the Services.
Where permitted by law, you grant ZEMBIRA a non-exclusive right to use submitted feedback or reviews for legitimate business, service, operational, and promotional purposes.
SECTION 12 – PRIVACY
Personal information collected through the Services is handled according to the ZEMBIRA Privacy Policy.
The Privacy Policy can be reviewed through the Privacy Policy link provided on the ZEMBIRA store.
Because the store is powered by Shopify, certain information may also be collected and processed by Shopify in accordance with Shopify’s applicable privacy terms and policies.
SECTION 13 – THIRD-PARTY SERVICES AND LINKS
The Services may include links to, integrations with, or functionality provided by third parties, including Shopify, payment processors, fulfillment providers, social platforms, or other service providers.
ZEMBIRA is not responsible for the independent policies, practices, availability, or content of third-party websites or services that ZEMBIRA does not control.
Customers should review the applicable terms and policies of third-party services they choose to use.
SECTION 14 – RELATIONSHIP WITH SHOPIFY
ZEMBIRA is powered by Shopify.
Purchases from the ZEMBIRA store are transactions between the customer and ZEMBIRA.
Shopify provides ecommerce technology and related services but is not the seller of ZEMBIRA products unless expressly stated otherwise by Shopify.
SECTION 15 – AUTOMATED SYSTEMS AND AI AGENTS
Automated systems, software agents, AI agents, search systems, and similar technologies may access publicly available portions of the Services only when they comply with applicable law, platform requirements, technical access controls, and any restrictions communicated by ZEMBIRA or Shopify.
Automated systems must not attempt to bypass security controls, access restricted information, impersonate customers, circumvent CAPTCHAs or authorization systems, or interfere with the normal operation of the Services.
ZEMBIRA may limit or block automated access that is abusive, deceptive, unauthorized, harmful, or inconsistent with applicable platform rules.
SECTION 16 – PROHIBITED USES
You may not use the Services:
• for unlawful or fraudulent purposes;
• to violate intellectual-property rights;
• to transmit malicious code, viruses, or harmful software;
• to collect personal information without authorization;
• to impersonate another person or entity;
• to interfere with website security or operation;
• to send spam, phishing messages, or deceptive communications;
• to attempt unauthorized access to accounts, systems, or data;
• to scrape, copy, reproduce, or exploit protected content in violation of applicable law or these Terms;
• or for any activity that materially harms ZEMBIRA, Shopify, customers, or other users.
SECTION 17 – SERVICE AVAILABILITY AND ERRORS
ZEMBIRA does not guarantee that the Services will always be uninterrupted, error-free, or continuously available.
Occasionally information may contain typographical errors, inaccuracies, omissions, outdated information, or technical issues related to product descriptions, availability, shipping, promotions, or other store information.
ZEMBIRA may correct such errors and update information when reasonably necessary.
SECTION 18 – DISCLAIMER
To the fullest extent permitted by applicable law, the Services and products are provided subject to the descriptions, policies, warranties, consumer protections, and legal rights that apply to the transaction.
ZEMBIRA does not guarantee that use of the website or Services will always be uninterrupted, secure, or error-free.
Nothing in this section excludes or limits rights or warranties that cannot legally be excluded or limited.
SECTION 19 – LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, ZEMBIRA will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the Services, except where such limitation is prohibited by law.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
SECTION 20 – INDEMNIFICATION
To the extent permitted by applicable law, you agree to be responsible for losses, claims, or liabilities resulting from your unlawful use of the Services, your violation of these Terms, or your infringement of the rights of another person.
SECTION 21 – SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in effect.
SECTION 22 – NO WAIVER
Failure by ZEMBIRA to enforce any provision of these Terms does not waive the right to enforce that provision or any other provision later.
SECTION 23 – GOVERNING LAW
These Terms are governed by applicable United States federal law and the applicable laws of the State of Florida, without limiting any mandatory consumer rights that may apply based on the customer’s location.
Any dispute will be handled in a court or forum with proper legal jurisdiction, unless applicable law requires otherwise.
SECTION 24 – CHANGES TO THESE TERMS
ZEMBIRA may update these Terms from time to time for operational, legal, regulatory, technical, or business reasons.
The current version will be posted on this page. Material changes will be handled in accordance with applicable law.
Continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms where permitted by law.
